Refund Policy
1. Definitions
1.1. “Program Cost” is cost that covers the: tuition fee, admission to Program events, accommodation and meals, transportation from airports and between different venues in the USA, all pre-departure briefings and materials, Actura-certified Group Manager per group, Actura-certified Group Assistant per group and one accompanying teacher per group
1.2. “Force majeure” means event that no human foresight could anticipate or which, if anticipated, is too strong to be controlled. Such as natural disasters, fire, explosion, war, strike, or any other event beyond the reasonable control of Actura which prevents or delays the implementation of the Program or travel to or from U.S.A. or New Zealand;
2. Actura has its discretion to determine the components and itinerary of the Program and to make any changes to it as may be required due to changes in circumstances or an event of force majeure occurs.d;
3. If prior to the commencement of the Program (a) the Student suffers any illness or injury and is assessed by a qualified and licensed medical specialist as being unfit for participating in the Program, or (b) a close relative of the Student dies or suffers a major illness or traumatic event, the Student must notify Actura in writing with full details of the occurrence and a copy of the medical assessment or evidence. If satisfied with the assessment or evidence, Actura will refund to the Student an amount up to 50% of the Program Cost but not exceeding the amount the Student has paid at the time of cancellation and less Actura’s unrecoverable expenses. Some costs may be recoverable in accordance with the travel insurance policy.
4. If during the Program the Student suffers any illness or injury and is assessed by a qualified and licensed medical specialist as being unfit for continuing to participate in the Program, and Actura agreed with such assessment, then the Student will be entitled to withdraw from the Program in which event:
4.1. Actura will consult with the accompanying school’s staff and the Student’s parents on the most appropriate mode of travel back to New Zealand;
4.2. all costs incurred in arranging such early return travel to New Zealand, including but not limited to, the cost of changing flights or buying new air fares, additional staff arrangements for accompanying the student back to New Zealand, or additional accommodation or meals must be borne by the Student’s parents who agree to indemnify Actura in respect thereof. Some costs may be recoverable in accordance with the travel insurance policy;
4.3. if the Student’s parents decide that the Student should return to New Zealand immediately but the parents are unable to travel to accompany the Student’s return trip then arrangement will be made for the Student to travel independently to return to New Zealand and the Student’s parents agree to indemnify Actura against all claims, losses, and expenses that occurs to the Student during his travel back to New Zealand;
4.4. Actura will endeavor to obtain a refund of part of the Program Cost for any part of the Program which has not yet been completed but in any event the amount to be refunded will not exceed 35% of the Program Cost.
